Draft — pending legal review. Effective date to be added once finalized.
DRAFT — pending legal review. This Terms of Use has been prepared by combining our previously published Terms with new provisions for the WriteStories clinical platform. It has not yet been reviewed by an attorney and should not be relied upon as final. Open items still being finalized: HIPAA/BAA language, the Institutional Master Services Agreement referenced in Sections 3 and 4, and the Effective Date.
Welcome to Scriptive LLC's (“SCRIPTIVE,” “Company,” “we,” “us,” or “our”) website and the WriteStories platform (together, the “Site”). By accessing or using the Site, you (“User” or “you”) signify that you have read, understand, and agree to be bound by (1) these Terms of Use and (2) the Scriptive LLC Privacy Policy. These Terms constitute a legally binding agreement between you and SCRIPTIVE, including any organization, practice, school, or district on whose behalf you are acting.
SCRIPTIVE LLC is a Wisconsin limited liability company. We may modify these Terms at any time; if we do, we will post the revised Terms on this page. Your continued use of the Site after such changes constitutes acceptance of the modified Terms.
The Scriptive LLC Privacy Policy governs the collection, use, and protection of information through the Site and the WriteStories platform, and is incorporated into these Terms by reference.
a) Adult Accounts. Adult Accounts may be created by parents or legal guardians (“Adult Users”) of children between the ages of 3 and 18 who use the learning portions of the Site (“Child Users”).
b) Child Sub-Accounts. Adult Users may create individual Child Sub-Accounts for each child in their care, linked to and controlled by an Adult Account.
c) SLP / Clinician Accounts. Licensed speech-language pathologists and other qualified clinicians (“Clinician Users”) may create a professional account to manage a caseload, assign content, and access clinical scoring and documentation tools. Clinician Users represent that they hold any applicable professional license required in their jurisdiction.
d) Institutional Accounts. Schools, districts, clinics, or other institutions (“Institutions”) that wish to license the platform at scale must execute a separate written Master Services Agreement and, where applicable, a Data Processing Agreement with SCRIPTIVE. Where an Institution has executed such an agreement, it governs to the extent its terms conflict with these Terms.
e) Age Requirement. The learning portions of the Site are intended for individuals age 3 and older, provided that users under 18 use the Site under the supervision of a parent, guardian, clinician, teacher, or administrator at least eighteen (18) years of age.
a) Free Therapeutic Tier. Family accounts for a Child User receiving services from a Clinician User are free of charge and do not require payment information. This tier remains free for as long as the Child User is receiving services, regardless of the Clinician User's own subscription status.
b) SLP Professional Subscription. Clinician Users may access a 30-day free trial with no payment information required to begin. Following the trial, continued access requires a paid annual subscription at the then-current published rate.
c) Sibling+ and AI Complete. Sibling+ is an optional paid add-on on top of the free Therapeutic Tier. AI Complete is a planned add-on not yet available for purchase; features and pricing are subject to change prior to launch.
d) Billing and Renewal. Paid subscriptions renew automatically for the same term at the then-current rate unless cancelled prior to the renewal date. We use a third-party payment processor.
e) Cancellation and Refunds. You may cancel a paid subscription at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable, except where required by law.
f) Institutional Billing. Institutional Account billing is governed by the applicable Institutional Agreement, not this Section.
WriteStories is a clinical support tool intended to assist, not replace, the professional judgment of a qualified clinician. Any automated or AI-assisted scoring or suggestion is a suggestion only, and does not constitute a clinical finding until independently reviewed and accepted by a Clinician User. Clinician Users remain solely responsible for all clinical decisions made using the Site.
Certain WriteStories features use third-party AI services to support narrative-language scoring. Student writing samples submitted for this processing are anonymized before transmission, consistent with our Privacy Policy. We require a Zero Data Retention agreement with any AI service provider before that provider may process student-authored content in production.
Some Clinician Users may be, or may work within, a “covered entity” under the Health Insurance Portability and Accountability Act (“HIPAA”). SCRIPTIVE does not represent that the Site is “HIPAA compliant” as a general matter. Upon request, SCRIPTIVE will make available a Business Associate Agreement to Clinician Users or Institutions who are HIPAA-covered entities or business associates and require one to use the Site in connection with protected health information.
You agree to provide accurate Registration Data, maintain the security of your password, and remain responsible for all activity under your account. Notify us immediately of any breach at security@scriptive.us. We are not liable for losses caused by unauthorized use of your account.
a) Ownership. All Site Content is owned by SCRIPTIVE or licensed to SCRIPTIVE by third parties, with all rights reserved.
b) Limited License. We grant you a limited, personal, non-exclusive, revocable license to access and use the Site consistent with your account type. This license does not permit data mining or scraping.
c) Student-Authored Content. Stories authored by a Child User remain the property of that Child User (or their parent/guardian). By using the Site, you grant SCRIPTIVE a limited license to store, process, and display that content solely to provide the Services.
d) Third-Party Content. SCRIPTIVE is not responsible for third-party sites linked from the Site.
You agree not to: use the Site unlawfully or in a way that could damage it; use automated scripts to collect Site data; upload unlawful, threatening, or objectionable content; create an account for anyone other than yourself or a child in your care; impersonate any person, or misrepresent your credentials; upload spam or malicious code; use another's account; or reverse-engineer the Site.
The Site and all associated trademarks and logos are owned by or licensed to SCRIPTIVE. You obtain no ownership interest in the Site through your use of it.
If you believe Site Content infringes your copyright, submit a written DMCA notice to our Copyright Agent at copyright@scriptive.us or by phone at (608) 319-1996, including identification of the work, the allegedly infringing material, your contact information, and a good-faith statement under penalty of perjury.
The Site is provided “AS IS” and “AS AVAILABLE.” SCRIPTIVE disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and does not guarantee any specific clinical or educational outcome from use of the Site.
To the maximum extent permitted by law, SCRIPTIVE will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site. SCRIPTIVE's total liability to you will be limited to injunctive relief only, except where prohibited by law.
You agree to defend, indemnify, and hold harmless SCRIPTIVE from claims arising from your use of the Site, your violation of these Terms, or your violation of any third party's rights or applicable law.
SCRIPTIVE may suspend or terminate your access to the Site at any time, for any reason, in its sole discretion. Institutional Accounts are subject to the termination provisions of the applicable Institutional Agreement.
You may not assign these Terms without SCRIPTIVE's prior written consent. SCRIPTIVE may assign these Terms without restriction.
These Terms are governed by the laws of the State of Wisconsin. Except as provided in Section 19, any action relating to these Terms must be brought in the state or federal courts located in Wisconsin.
Except for infringement of intellectual property rights or violations of Section 10, disputes relating to these Terms shall be resolved by final and binding arbitration administered by the American Arbitration Association. No class or representative arbitration is permitted. Claims must be brought within three (3) years after the cause of action arose.
Feedback you provide about the Site is non-confidential and becomes SCRIPTIVE's sole property, usable without acknowledgment or compensation to you.
These Terms constitute the entire agreement between you and SCRIPTIVE, except for any Institutional Agreement executed separately. If any provision is held invalid, the remainder continues in full force.
